About Ontario Sublet Agreement Template
A sublet agreement records the deal between an existing tenant (the head tenant) and a subtenant who will live in the unit for a fixed period while the head tenant keeps the tenancy. In Ontario the head tenant needs the landlord's written consent, which cannot be unreasonably withheld, and remains responsible to the landlord for the rent and the unit. The subtenant pays the head tenant, must leave at the end of the agreed period, and cannot be charged more than the rent the head tenant pays.
The agreement should set the dates, the rent and how it is paid, the deposit (in Ontario only a last month's rent deposit is allowed), who is responsible for utilities and damage, and the rules of the unit. Because the sublet ends on a fixed date, a subtenant who stays past it can be removed through a Board application using Form A2. This is a free template and general guide, not legal advice.
