About Ontario LTB Form A2, Application About a Sublet or an Assignment

Form A2 is the Landlord and Tenant Board application about subletting and assigning a rental unit. A tenant can use it when the landlord has refused permission to sublet or assign without a reasonable basis, or has not answered within seven days. A landlord or tenant can also use it when a subtenant has stayed past the end of the sublet and will not leave, or when an unauthorised occupant is in the unit.

Ontario tenants have a right to sublet or assign with the landlord's consent, and that consent cannot be unreasonably withheld. Where the landlord refuses an assignment outright, the tenant can instead end the tenancy with only 30 days' notice on Form N9. This is a free fillable helper and general guide, not legal advice.

How to fill out Ontario LTB Form A2, Application About a Sublet or an Assignment

1. 1Enter the rental unit address and the names of the tenant, landlord, and (if relevant) the subtenant or occupant.
2. 2Tick the reason: the landlord unreasonably refused consent, did not respond, or a subtenant or occupant has overstayed.
3. 3Describe the request you made, when you made it, and the landlord's response, attaching copies.
4. 4State the remedy you want: an order allowing the sublet or assignment, an order ending the tenancy, or an order evicting the overstaying subtenant.
5. 5Sign, date, pay the fee, file, and serve the other parties as directed.
