About Ontario LTB Form N5, Notice to End Tenancy for Interfering with Others, Damage or Overcrowding
Form N5 is served when a tenant, an occupant, or a guest has substantially interfered with the reasonable enjoyment or lawful rights of the landlord or other tenants, has caused undue damage, or has allowed more people to live in the unit than health and safety standards permit. It is a corrective notice: the first N5 gives the tenant seven days to stop the behaviour, repair or pay for the damage, or reduce the number of occupants, and if they do, the notice is void.
A second N5 served within six months of a first one that was voided cannot be voided, and it gives 14 days' notice. The details section matters more than any other part of the form: dates, times, what happened, and who was affected. A vague N5 is routinely dismissed at the Board.
